When we provide a proposal for a pool we do it in the form of a very detailed scope letter in order to create an understanding between us and the owner as to what we include or do not include because we feel that it is our resposibility to define what they should expect from us rather than let them come to their own expectaions.Once the owner agrees to accept our proposal we attach agreed conditions to it and get them to sign the agreement. The agreed conditions detail all of the legalities of the agreement as well as disclaimers.Do you do the same or how do you quote and contract and what type of agreed conditions do you use?How could we go about creating a standard ageement form for all to use to gain the utmost protection for ourselves as well as making the client more informed as to the proposal?

  • Nicholas,
Thanks for sending your agreed conditions.
You have a lot of what I use in your form.
I had a local attorney help with mine and we have added a lot of things that pertain to safety as well.
See what you think of what I use and if it contains items you may want to add.

Attached is a representation of the Agreed Conditions/Warranties/Disclaimers that we have adopted over the years. I hope all find this useful and I would love feedback. Am i missing something? Should there be anything removed.

  • Thanks.
I am always wondering what others do in this respect and if someone does something better than I then I will make changes to the way I do it.
I thought it would make interesting conversation and hopefully cause some thinking and upgrading.
