Here is a positive outcome of a recent litigation between National Swimming Pool Foundation and Nebraska Health DepartmentsThe National Swimming Pool Foundation® (NSPF®), a non-profit 501(c) (3) organization, announced today that it has received settlement payments totaling $168,000 to resolve a copyright infringement lawsuit against the state health department in Nebraska and three counties. The Central District of Nebraska, the State of Nebraska, the Lincoln/Lancaster County and the Douglas County Nebraska Health Departments were alleged to have used NSPF educational materials published between 1983 and 2007.

NSPF will direct all proceeds beyond attorney fees, approximately $80,000, to the NSPF grant budget.“When a dispute can be transformed into an opportunity to fund research, all parties win,” explained Dr. Lachocki. “The NSPF Board is committed to funding research that solves environmental health problems.”

NSPF has also announced an amnesty program to other health departments that may be using NSPF materials.
